Artist Management Agreement Form: An Overview
An artist management agreement is a legally binding contract that outlines the terms and conditions between a talent agent or manager and an artist. The agreement includes details on the services provided by the manager, the duration of the contract, payment terms, ownership of the work, and more.
Key parts of the music artist management agreement
The critical parts of a sample artist management agreement that should be included are:
- Scope of Services: outlines the manager's responsibilities to the artist, including areas of representation such as booking shows or negotiating contracts.
- Term of Agreement: indicates the length of time that the manager will represent the artist. It's important to note the start and end dates and any provisions for renewal.
- Compensation: outlines how the artist will pay the manager for their services. Compensation is typically based on a percentage of the artist's earnings. It's important to outline how much the manager is entitled to receive clearly.
- Exclusivity: outlines whether or not the artist will be working exclusively with the manager or whether the artist can work with other representatives.
- Termination: outlines the terms and conditions for either party to terminate the agreement. It typically allows for termination with or without cause, but financial penalties may be associated with early termination.
- Intellectual Property Ownership: outlines who owns the intellectual property rights to the artist's work and who has the right to exploit these rights.
- Representations and Warranties: outline any assurances or promises made by both parties in the agreement, such as the artist's ability to perform or the manager's expertise and experience in the music industry.
- Dispute Resolution: outlines how any disputes between the parties will be resolved. This could include mediation, arbitration, or going to court.

Types of an artist management agreement
There are typically two types of artist management agreements: the exclusive contract and the non-exclusive contract. But there are also some other types; here are the main ones:
- Exclusive Management Agreement: the artist gives the manager complete control of their career. The manager will have the exclusive right to book shows, manage finances, and make major career decisions.
- Non-Exclusive Management Agreement: the artist may work with other managers or agents, in addition to their current manager. this type of agreement offers more freedom to the artist, but there could be conflicts if the different managers are not aligned on how to manage the artist's career.
- Commission-Based Agreement: this type of agreement allows the manager to earn a commission or percentage of the artist's income from shows, merchandise, or any other revenue stream. The commission typically ranges from 15% to 20%.
- Flat Fee Agreement: the artist pays the manager a flat fee for their services. This fee may be a one-time payment or a recurring payment.
- Personal Management Agreement: this type of agreement is more comprehensive than other types of artist management agreements. In addition to booking shows and managing finances, the manager may also assist with branding, publicity, and law-related issues.
- Production Agreement: some artist management agreements also include a production element, where the manager is responsible for finding studio space, engineers, and other members of the production team for the artist's recordings.
