What is form I-539?

I-539 is a form issued by the U.S. Citizenship and Immigration Services (USCIS), which allows people in the U.S. on non-immigrant (temporary) visas to apply for a different type of visa (change status) or extend their stay in the U.S. States. A non-immigrant visa allows a foreigner to enter and stay in the United States for a specific purpose and for a limited period of time.

What I need the I-539 for?

Form I-539 can be used if the non-immigrant wants to extend their stay in the United States. Non-immigrants are considered temporary visitors who must comply with the specific conditions of the visa, depending on what they do in the United States.

However, there is a list of visas using which you can apply for extending your stay in the US:

  • Diplomatic visas (A-1 – A-3);
  • CW-1 dependents;
  • Business and tourist visas B1, B2;
  • H Visa dependents;
  • F (Academic student visas);
  • L (Company transfer visas);
  • J1 Visa Exchange;
  • M professional or non-academic student visas;
  • TD dependents.

The Form I-539 is also must be supported by:

  • The extension visa filing fee;
  • Printed I-94 form;
  • Clear copies of all your passport pages (including the blank ones);
  • Financial support proofs;
  • A letter that explains your reason to stay in the US for a longer time.

Filling out the I-539 form

The I-539 form includes several parts to fill:

Part 1: You have to provide your personal information:

  • Applicant’s full name;
  • Address;
  • Country and date of birth;
  • SSN;
  • Date of the last arrival into the US;
  • I-94 Number;
  • Current status;
  • Date of visa expiration.

Part 2: Application type;

Part 3: Processing the information;

Part 4: Other important information about the applicant (including passport number, address in the other country, information about the applicant’s background);

Part 5: Candidate’s declaration and signature (contains the signature, date of filing, full name, e-mail address, and mobile number);

Part 6: Interpreter’s Statement (if needed).
