What required the anti-arson application?
The New York State Department of Financial Services explains: "11 NYCRR Subpart 62-4 implements Insurance Law Section 3403 by requiring a two-tier anti-arson application for new and renewal insurance policies or binders covering the peril of fire or explosion."
Is it still required?
The department says that Chapter 439 of the Laws of 2025 "repealed Section 3403 effective October 16, 2025, and requires the Superintendent of Financial Services (“Superintendent”) to repeal all rules and regulations that implement Section 3403." Its final rule says: "11 NYCRR Subpart 62-4 is hereby repealed."
