1. What is an 8752 Form?

Form 8752 (Required Payment or Refund Under Section 7519) is a federal tax form designed and processed by the Internal Revenue Service (IRS). The form is used for figuring out and reporting the payments required in section 7519 for requesting a refund for payments made during prior years. This form must be filed separately, so don’t attach it to 1065 or Form 1120-S. 

2. What I need the 8752 Form for? 

  • Complete this form blank if you are on behalf of a partnership or an S corporation, and you need to figure out and report the payment under section 7519;
  • File to know whether your business has the right for a refund on the prior years or not;
  • Use the fillable form 8752 to request a refund of the net required balance if you liquidate the eligible entity;
  • Don’t complete this form for your personal service corporation. Use Form 1120 Schedule H instead. 

3. How to fill out Form 8752?

  • Identify your partnership or S corporation (enter address, EIN, etc.);
  • Check the boxes (from A to D) that apply to you;
  • Complete lines 1-12 to calculate net income for the base year, deferral ratio, the deferred amount, required payment due, and refunds for prior year payments (if needed); 
  • Sign the form and title it;
  • Keep a signed copy in your records;
  • File before May 15 of the current financial year.
