1. What is a 5330 Form?

The IRS Form 5330 (Return of Excise Taxes Related to Employee Benefit Plans) is a tax form that is used for reporting and paying the employee benefit plan-related excise tax. The form is rather big and can report taxes on a variety of other transactions, contributions, failures, deficiencies, etc. The form isn’t followed by other documents unless requested by the IRS. It can be filed by businesses and private entities.

  • When you need to report taxes on one of the following  Internal Revenue Code sections: 4965, 4971, 4975, 4979A, 4980, 4976, 4977, 4978, 4979, 4972, 4973(a)(3), and 4980F;
  • If you are one of the 16 employers categories listed in the full instruction for the form;
  • If you have to return excise taxes to one or more employee benefit plans;
  • If you are a paid preparer, enter your personal information and EIN. The owner’s signature is needed anyway. 

3. How to fill out Form 5330? 

  • Part I – fill only one field that matches the section you are reporting. Read through sections A-F before filling;
  • Part II – make all the required calculations here to receive your tax due size;
  • Examine all the Schedules from A to J and use the one that matches your case;
  • Double-check the entered information and sign the form for validation;
  • Fill more copies of the form if you need to cover more than one excise tax.
