What Is OREA Form 405?

The blank on this page is the 2011 revision of OREA Form 405, which at that time was the "Amendment to Agreement to Lease" for residential tenancies in Ontario. OREA has since renumbered its residential lease forms: in OREA's Standard Forms index (2024 edition) Form 405 is "Termination of Agreement by Tenant – Agreement to Lease – Residential", and the amendment form is Form 420, "Amendment to – Agreement to Lease – Residential". The Form 420 blank on PDFLiner is the 2019 revision and is not presented as the current edition. The purpose of OREA form 405 

The Ontario Lease Amendment Form is used for:

• Lease Term Modification. It amends an existing residential lease agreement.
• Official Record. It documents alterations or additions to the initial terms.
• Mutual Agreement. It requires agreement and signatures from both landlord and tenant.

Who should initiate the amendment to lease agreement?

Both parties of the deal are allowed to start changing the initial agreement and suggest amendments through the Lease Amendment Form. For this initiative to be successful, both the landlord and the tenant should discuss the changes in detail and only then make them official. Examples of lease agreement changes

Examples of lease agreement changes vary depending on a particular situation. Here are some of them: modifying rent amounts or payment schedules, extending the rent duration, updating maintenance responsibilities, adding or removing specific clauses, and permitting or restricting aspects like pet ownership or property alterations. Any agreed change must comply with the Residential Tenancies Act, 2006: a term cannot shift repairs that are the landlord's responsibility onto the tenant, and a no-pets clause is void (condominium rules may still restrict pets).

Amendments and the Ontario Standard Lease

An OREA amendment changes an existing Agreement to Lease. Form 400 begins as an offer; once accepted, it is a binding agreement to enter into the lease, subject to its terms and conditions. For most private residential tenancies in Ontario, new tenancy agreements signed on or after April 30, 2018 must use the government's Residential Tenancy Agreement (Standard Form of Lease), Ontario form 047-2229 (December 2020 edition for covered new agreements signed on or after March 1, 2021). Once the tenancy is on the standard lease, changes agreed between the landlord and tenant must be recorded in writing (section 16 of the standard lease); the lease also notes that the Residential Tenancies Act, 2006 allows some rent increases and requires some rent reductions without agreement between the landlord and tenant.
