What Is OREA Form 401?

OREA Form 401 is "Schedule ___ – Agreement to Lease – Residential": a schedule page that is attached to OREA Form 400, the Agreement to Lease – Residential, to hold additional terms the landlord and tenant agree on (for example utilities, parking, keys or condominium rules). It is not a rental application; the application is OREA Form 410. The blank on this page is the 2014 revision of Form 401.

OREA Form 400 and the Ontario Standard Lease

OREA Form 400 with its Schedule is the offer stage of a rental; once accepted it is a binding agreement to enter into the lease. For most private residential tenancies in Ontario, new tenancy agreements signed on or after April 30, 2018 must use the government's Residential Tenancy Agreement (Standard Form of Lease), Ontario form 047-2229; covered new agreements signed on or after March 1, 2021 must use the December 2020 edition. The standard lease does not apply to care homes, sites in mobile home parks and land lease communities, most social and supportive housing, certain other special tenancies and co-operative housing.
