What Is a Notice to Appear?

A Notice to Appear is a written order that is given by a law enforcement officer in charge of physical arrest to an individual accused of violating the law. This person must appear in a specified governmental office or court at a determined date and time. A police officer may issue a Notice to Appear for a municipal ordinance or a misdemeanor violation but not for a felony.

How long does it take to get a notice to appear

It depends on how fast the police officer files this document with the designated court. According to the law, no less than ten days must pass from the moment you get the NTA and the appointed court hearing. This term provides you with enough time to find a lawyer and collect the required documents. However, you may waive the 10-day notice requirement. The document will contain the exact date, time, and place for the first court hearing. If you don’t appear on the determined date in court, the judge may issue a warrant for your arrest.

Who can issue a notice to appear

If a person is convicted of a law violation, a US Immigration and Customs Enforcement officer can issue a Notice to Appear. They have the legal power to decide whether to issue this notice in a specific case. They prioritize deporting non-US residents who might risk public safety or a danger to national security in the United States.

According to current statistics, US Customs and Border Protection or CBP issues NTAs to no more than 10% out of 300,000 arriving aliens annually.
