What is Form I-130?

Form I-130 is the Petition for Alien Relative from U.S. Citizenship and Immigration Services (USCIS).

A U.S. citizen, lawful permanent resident, or non-citizen U.S. national may file it to establish a relationship to certain alien relatives who wish to immigrate to the United States.

If you are filing for your spouse, your spouse must complete and sign Form I-130A, Supplemental Information for Spouse Beneficiary. If your spouse is overseas, Form I-130A must still be completed, but your spouse does not have to sign it. Submit Form I-130A with Form I-130; this page offers Form I-130 only.

How USCIS accepts Form I-130

USCIS lists online filing and filing by mail (paper) on its I-130 page; online filing starts with creating an account or logging in if you already have one.

For a paper Form I-130 petition, USCIS will not accept a stamped or typewritten name in place of a required signature.

For paper filing, a photocopy, fax, or scan can satisfy the signature requirement only if it is a copy of the original request or document containing the handwritten ink signature.

USCIS lists “04/01/24” under “Edition Date”.
